Welcome to Dirt2Street.com (the “Site”), operated under the trade name Dirt2Street. Dirt2Street is a trade name of Family Powersports, Inc., a Texas company with its principal place of business at 4160 Houston Harte Expwy San Angelo, TX 76901. References to “Dirt2Street,” “we,” “us,” or “our” throughout these Terms refer to this legal entity.

By accessing, browsing, or purchasing from this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”), as well as any additional policies referenced herein or available by hyperlink. If you do not agree to these Terms, you are not authorized to access the Site or use our services.

These Terms apply to all users of the Site, including without limitation browsers, vendors, customers, merchants, and contributors of content.

By using this Site, you represent and warrant that you are at least the age of majority in your state or province of residence and possess the legal capacity to enter into a binding agreement.

Use of Our Website

You agree to use this Site only for lawful purposes and in accordance with these Terms. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction through your use of the Site.

We reserve the right to refuse service to anyone for any reason at any time, including if we suspect fraudulent activity, unauthorized resale, or abuse of our policies. 

Order Acceptance and Cancellation

Your placement of an order constitutes an offer to purchase from us. Receipt of an order confirmation email does not signify our acceptance of your order. We reserve the right, at our sole discretion, to accept or decline any order for any reason, including but not limited to product availability, errors in pricing or product information, suspected fraud, or restrictions imposed by shipping carriers.

In the event that we cancel an order after payment has been processed, a full refund will be issued to the original method of payment.

Product Information and Pricing

We strive to ensure that all product descriptions, images, specifications, and pricing are accurate and up to date; however, errors may occur. We do not warrant that product descriptions or other content on this Site are error-free, complete, reliable, current, or free of omissions.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

If a product is listed at an incorrect price due to a typographical error, supplier pricing update, or system malfunction, we reserve the right to refuse or cancel any orders placed for that product, even if the order has been confirmed and payment has been captured. Our acceptance of an order does not obligate us to honor an incorrect price.

Inventory Availability and Fulfillment

Dirt2Street operates within a dynamic supply chain, and some products may ship directly from manufacturer or distributor warehouses. Inventory levels displayed on the Site are estimates and are not guaranteed.

Occasionally, items may become unavailable after an order is placed. If this occurs, we will notify you and issue a refund if the item cannot be fulfilled within a reasonable timeframe.

Shipping and delivery dates are estimates only and are not guaranteed. Dirt2Street is not responsible for delays caused by shipping carriers, weather events, supply chain disruptions, labor shortages, customs processing, or other circumstances beyond our control.

Title and risk of loss pass to you upon our transfer of the shipment to the carrier.

Pre-Orders and Backorders

From time to time, we may offer products for pre-order or backorder. By placing such an order, you acknowledge that release dates and restock timelines are subject to change and may be affected by manufacturer delays outside of our control.

You may cancel a pre-order for a full refund any time prior to shipment unless otherwise stated on the product page.

Assumption of Risk and Safety Disclaimer

Motorcycling and powersports activities are inherently dangerous and involve risks that may result in serious bodily injury, permanent disability, or death.

Protective gear and safety apparel are designed to help reduce certain risks; however, no helmet or protective equipment can guarantee protection from injury or death.

By purchasing and using products sold by Dirt2Street, you voluntarily assume all risks associated with these activities.

To the fullest extent permitted by law, Dirt2Street disclaims all liability for injuries, damages, or losses arising from the use or misuse of any products purchased from this Site.

Helmet and Protective Equipment Notice

Helmets and protective equipment sold on this Site are manufactured to meet applicable safety standards at the time of production. However, impacts exceeding testing conditions may result in product failure.

Helmets are designed to provide limited protection and should be replaced after a significant impact or crash, even if no visible damage is present.

Dirt2Street makes no representation or warranty that any protective product will prevent injury.

Fitment, Sizing, and Product Selection

Proper fit and compatibility are critical for both safety and performance. Customers are solely responsible for reviewing sizing charts, product specifications, and manufacturer recommendations before purchase.

Dirt2Street shall not be liable for damages or injuries resulting from improperly fitted, incompatible, or incorrectly installed products.

Proper Use of Products

You agree to use all products in accordance with manufacturer instructions and intended use. Dirt2Street is not responsible for harm resulting from improper installation, misuse, unauthorized modifications, negligence, or normal wear and tear.

Manufacturer Warranties

Many products sold by Dirt2Street are covered by manufacturer warranties. Warranty determinations are made solely by the manufacturer and are subject to their policies and procedures.

After a product has been used, warranty claims typically must be handled directly with the manufacturer unless otherwise required by law. While we are happy to assist customers experiencing difficulty with the warranty process, we cannot guarantee outcomes.

Except for manufacturer warranties expressly provided with certain products, all products and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Dirt2Street disclaims all implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, Dirt2Street shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or any products purchased from us.

Our total liability for any claim shall not exceed the amount paid for the product giving rise to the dispute.

Indemnification

You agree to indemnify, defend, and hold harmless Dirt2Street and its owners, employees, affiliates, and partners from any claims, damages, liabilities, costs, or expenses arising from your misuse of products, violation of these Terms, or infringement of any law or third-party rights.

Chargebacks and Payment Disputes

We encourage customers to contact us directly to resolve any issues prior to initiating a chargeback. If a chargeback is filed, we reserve the right to provide documentation to the payment processor to demonstrate order authorization, shipment, and delivery confirmation. Accounts associated with repeated or abusive payment disputes may be restricted in accordance with applicable law.

Intellectual Property

All content on this Site—including text, graphics, logos, images, and design—is the property of Dirt2Street and is protected by applicable intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

Force Majeure

Dirt2Street shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of war, terrorism, labor disputes, supply shortages, transportation failures, governmental actions, or interruptions in utilities or communications.

Binding Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, your purchase of products, or your use of the Site shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.

Arbitration shall take place in [Your State], unless otherwise required by law. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement.

You and Dirt2Street agree that arbitration shall be conducted on an individual basis only. Class actions, collective actions, and representative proceedings are not permitted.

Either party may bring an individual action in small claims court if the claim qualifies.

You may opt out of this arbitration provision by providing written notice to us within thirty (30) days of your first purchase from Dirt2Street.

Nothing in this section limits any rights that cannot be waived under applicable law.

Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the state in which Dirt2Street operates, without regard to conflict-of-law principles. 

Changes to These Terms

We reserve the right to update, modify, or replace these Terms at any time by posting updates to this page. Your continued use of the Site following any changes constitutes acceptance of those changes.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or statutory consumer protections where required.
